INFORMATION ON PRICES FOR THE PROVISION OF LEGAL SERVICES

 

The price of legal services can be negotiated in several ways, namely:

 

- Timebased rate where the fee for legal services is determined by the number of hours spent providing legal services. In the case of the time rate, the following price list applies:

 

2.000,- CZK/h - for natural persons not engaged in business,
2,500 CZK/hour - for corporations and entrepreneurs.

 

- Fee based on the regulation no. 177/1996 Coll., on the remuneration of advocates and compensation of advocates for the provision of legal services (advocate's tariff), or is negotiated after individual agreement with the client and taking into account the client's claims and requirements, as well as the complexity of the entire case and all its contexts.

 

- The fee is charged for each act of legal service. The amount of the fee for each act is determined either by agreement or by taking into account the lawyer's tariff, depending on the value of the case. What constitutes an act of legal service is also determined by the regulation. However, the lawyer and his/her client may, by agreement, determine a greater or lesser list of what constitutes an act of legal service.

 

- The rate for the handling of the case, where the fee is agreed upon as the total amount for the complete provision of the legal service. The fee is then charged regardless of the number of hours or the length of the legal assistance.

 

- The flat rate, where the fee is charged regardless of the number of hours or individual acts, the lawyer will charge the client a fee for each month that the legal services are provided.

 

- The percentage rate, where the attorney's fee is negotiated at an amount determined by a percentage of the subject matter of the legal assistance.

 

- A contingent fee may also be negotiated, where the lawyer is entitled to a fee only if the litigation is successfully concluded, or if the client achieves the objective agreed with the client, while otherwise the client pays only the out-of-pocket costs. For these types of fees, the amount does not normally exceed 25% (based on Resolution of the Board of Directors of the CBA No. 1/1997 Bulletin, Code of Ethics).

 

The most commonly used rate of our law firm is the above-mentioned time rate. The price can also be negotiated after an individual agreement with the client and taking into account the client's claims and requirements as well as the complexity of the whole case and all its contexts.

 

The remuneration for the provision of legal services is determined in accordance with the valid and effective legal norms, in particular Act no. 85/1996 Coll., the Advocacy Act, regulation no. 177/1996 Coll., the Regulation of the Ministry of Justice on the remuneration of advocates and the compensation of advocates for the provision of legal services (the Advocates' Tariff), and the resolution of the Board of Directors of the CBA No. 1/1997 of the Bulletin laying down the rules of professional ethics and the rules of competition of advocates of the Czech Republic (the Code of Ethics).

 

Unless otherwise agreed, in addition to the fee for legal services, the client is obliged to pay all expenses related to the provision of legal services, in particular court fees, postage and travel expenses when providing legal assistance outside the Capital City of Prague.

AK Poupětová/Poupě s.r.o. is a VAT payer. Therefore, the amount of VAT at the current rate is always added to the fee for legal services determined by one of the above methods. The current VAT rate is 21%.
