Information on out-of-court dispute resolution
On 5 February 2016, the Czech Bar Association was authorised by the Ministry of Industry and Trade of the Czech Republic to resolve out-of-court consumer disputes in the area of disputes between attorneys and consumers arising from contracts for the provision of legal services (based on Act No. 634/1992 Coll., on Consumer Protection, as amended). Information on the processing of personal data in the context of the provision of legal services
Personal data controller
The controller of your personal data is the company Advokátní kancelář Poupětová/Poupě s.r.o., ID No.: 27639215, with registered office at Konviktská 24, 110 00 Prague 1, Czech Republic, whose subject of activity is the practice of advocacy pursuant to Act No. 85/1996 Coll., on advocacy, as amended.
Legal basis for processing
The processing of your personal data is generally based on the legal title of conclusion and performance of a contract (according to the provisions of Section 5 (2) (b) of Act No. 101/2000 Coll., the Act on the Protection of Personal Data and on Amendments to Certain Acts, as amended).
We will therefore process your personal data on the basis of the contract for the provision of legal services that you conclude with us.
Scope of the processed data
We process your personal data to the extent necessary to fulfil the purpose of the performance of legal obligations arising from the regulations governing the practice of law. This is exclusively in connection with your legal representation, and the legal services requested by you, individual legal advice, and other activities provided by the lawyer.
As a rule, this will be your contact and identification data (including your birth number), which you provide to us for the purpose of providing legal services in a particular case. In addition, the data we obtain from other sources, e.g. provided by the opposing party, another person involved in the legal matter, or from public registers.
Purpose of processing
Your personal data will be used exclusively for the performance of activities related to your legal representation, and the legal services requested by you, individual legal advice, and other activities provided by the lawyer, to communicate with the opposing party, or other persons involved in the proceedings, public authorities (e.g. courts, administrative authorities) and other recipients according to your needs and instructions.
Period of processing of personal data
We will process your personal data for the duration of the legal representation and will archive it after the end of the legal representation in accordance with generally binding legal regulations, as a rule for 10 years, in accordance with the applicable legislation, in particular Act No. 499/2004 Coll. (Act on archiving and filing services and on the amendment of certain acts) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR).
Client's rights
The right of access to personal data means that the client has the right to obtain information from the data controller - the seller - about whether it processes his personal data and, if so, what the data are and how they are processed. The client also has the right to have inaccurate personal data concerning him corrected by the controller without undue delay at his request. The client has the right to complete incomplete personal data at any time.
The right to erasure of personal data represents, in other words, the obligation of the controller-seller to erase the personal data it processes about the client if certain conditions are met and the client so requests.
The client has the right to have the controller-seller restrict the processing of his personal data in certain cases. The client has the right to object at any time to processing that is based on the legitimate interests of the controller-seller, a third party or is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.
The right to data portability gives the client the possibility to obtain the personal data he has provided to the controller in a common and machine-readable format. He may subsequently transmit this data to another controller or, if technically feasible, request that the controllers transmit it between themselves.
The right to withdraw consent to the processing of personal data at any time does not apply as the client's personal data is processed for the performance of a contract with the client and not on the basis of consent to processing.
In the event that the client is in any way dissatisfied with the processing of their personal data carried out by the data controller - the seller, they may lodge a complaint directly with the data controller or contact the Data Protection Authority.

As we process your personal data on the basis of fulfilling a legal obligation, some ways of exercising your above rights may be excluded due to the nature of the processing.
